The deed is the document that matters most. Signing in the right capacity: heirs, executors, trustees and attorneys-in-fact
Many El Paso seller packages are not signed by a simple husband and wife. An estate sale is signed by the independent executor named in the letters testamentary; a trust sale by the trustee named in the certificate of trust; a sale for a parent in a nursing home by an agent under a durable power of attorney that the title company has approved and will record. The notary certificate must match: the signer appears in a representative capacity, and the ID we check belongs to the executor, trustee or agent, not to the estate or the parent. We ask the escrow officer to confirm capacity and vesting before we leave the office so no page has to be re-signed.
Cash closings and out-of-town sellers
A cash purchase has no lender, so the buyer's package is short — settlement statement, affidavits, a few disclosures — and the whole closing can happen at the buyer's kitchen table in Horizon City or the seller's living room in Socorro on the same evening. When the seller has already left El Paso, the title company overnights the package to them and books a notary in that city; when the seller is here and the buyer is elsewhere, we handle the El Paso side and coordinate the scan-back so funding is not delayed.
